Terms and Conditions of Use
These Terms and Conditions of Use, hereinafter the “T&Cs”, are intended to define the conditions of access to and use of the People Analyzer™ platform, published by VSI INNOVATION.
Purpose of the Service
People Analyzer™ is a professional human capital analysis platform enabling the distribution of questionnaires, the completion of psychometric tests, and the generation of analytical reports designed to support professional, managerial, HR, recruitment, skills development, and individual or collective decision-making.
Acceptance of the T&Cs
Access to and use of People Analyzer™ implies full, complete, and unconditional acceptance of these T&Cs by the user.
If the user does not accept these T&Cs, they must refrain from using the platform.
Access to the Platform
Access to People Analyzer™ may be provided either through a user account or via an invitation link allowing the user to complete a questionnaire or take a test.
Use of the platform is restricted to individuals aged at least 18 years. By using People Analyzer™, the user declares that they meet this minimum age requirement.
The user is responsible for maintaining the confidentiality of their login credentials, access links, and authentication methods. Any use carried out via their account or access link is deemed to be performed under their responsibility.
Description of Services
People Analyzer™ may notably allow:
- creation and management of user accounts;
- sending invitations to candidates, employees, or beneficiaries;
- completion of psychometric questionnaires;
- generation of individual or collective reports;
- analysis of profiles, behaviors, motivations, and professional or team dynamics;
- access to modules related to recruitment, management, communication, or professional support;
- involvement of authorized partner consultants where applicable.
VSI INNOVATION reserves the right to evolve, modify, suspend, or remove all or part of the platform’s features at any time, without entitlement to compensation.
Use of Psychometric Analyses
The analyses, scores, results, recommendations, and reports generated by People Analyzer™ are tools intended to support understanding and decision-making. They do not constitute, under any circumstances, an absolute truth, a medical evaluation, a psychological diagnosis, an automated decision, or a guarantee of future performance.
Results must always be interpreted with discernment, within their context, and supplemented by human, professional, and managerial judgment.
Decisions made based on results provided by People Analyzer™, particularly in matters of recruitment, mobility, management, orientation, training, or support, remain the sole responsibility of the client, the professional user, or the concerned organization.
No Automated Decision-Making
People Analyzer™ must not be used as an automated decision-making system producing, on its own, legal or significant effects on an individual.
Any decision involving an individual must be subject to independent and contextual human review.
User Obligations
The user undertakes to use People Analyzer™ in accordance with these T&Cs, applicable laws, professional standards, and principles of fairness, confidentiality, and non-discrimination.
It is strictly prohibited to use the platform to:
- infringe the rights, dignity, or privacy of any individual;
- make discriminatory or unlawful decisions;
- misuse results outside their legitimate professional purpose;
- extract, copy, reproduce, or resell reports, methods, or content;
- attempt unauthorized access to the platform or its data;
- disrupt or compromise the operation of the service;
- perform reverse engineering, scraping, bulk extraction, or technical copying.
Client Responsibility
The client is solely responsible for selecting individuals invited to use the platform, configuring access rights, informing concerned individuals, using the results, and making decisions based on generated reports.
The client guarantees that they have obtained all necessary authorizations to invite an individual to take a test or access results concerning them.
Access to Results
Access to results depends on the configuration defined by the client or the using organization. Results may be accessible to:
- the concerned user;
- the client or organization initiating the assessment;
- authorized partner consultants;
- authorized platform administrators.
The client is solely responsible for granted permissions and for properly informing the concerned individuals.
Intellectual Property
The People Analyzer™ platform, its architecture, interfaces, databases, questionnaires, reports, methodologies, analytical models, texts, graphic elements, trademarks, logos, brand names, algorithms, content, and, more broadly, all its components are the exclusive property of VSI INNOVATION or are subject to duly granted usage rights.
The trademarks People Analyzer™, T8™, and DISCpro™ are registered trademarks of VSI INNOVATION. Any unauthorized use, reproduction, imitation, alteration, association, registration, exploitation, or appropriation of these trademarks is strictly prohibited.
No intellectual property rights are transferred to the user or client as a result of accessing or using the platform.
It is strictly prohibited, without prior written authorization from VSI INNOVATION, to:
- reproduce, copy, distribute, publish, sell, rent, or transfer all or part of the platform;
- reproduce, copy, distribute, or resell generated reports outside the authorized contractual scope;
- extract or reuse all or part of databases;
- decompile, disassemble, analyze, or attempt to reconstruct the platform;
- create a competing service based on People Analyzer™ content or methods;
- use trademarks, names, or distinctive elements without authorization.
Any violation of intellectual property rights may result in civil and criminal proceedings, including for infringement, unfair competition, parasitism, or breach of trade secrets.
License
Subject to compliance with these T&Cs and payment of applicable fees, VSI INNOVATION grants a personal, non-exclusive, non-transferable, and revocable right to access and use the platform for internal professional purposes only.
This license does not confer any ownership rights over the platform or its content.
Financial Conditions
Access to certain services of People Analyzer™ is subject to payment. Applicable pricing is communicated to the client or displayed on the platform at the time of purchase.
Billing may include credits, subscriptions, modules, or additional services.
Unless otherwise stated, purchased credits are personal, non-transferable, non-exchangeable, and non-refundable.
All orders are final and binding. Payment is due according to the terms specified at purchase.
Payment
Payments may be processed via secure payment providers such as Stripe. VSI INNOVATION does not store full credit card details.
In case of non-payment or incident, VSI INNOVATION may suspend or restrict access to services without prejudice to outstanding amounts.
Refund Policy
Except where required by mandatory law, all payments made are final and non-refundable, including in cases of non-use, partial use, expiration, account deletion, suspension, or dissatisfaction with results interpretation.
Right of Withdrawal
Professional clients are not entitled to a right of withdrawal, unless required by law.
For consumers, where services involve digital content or immediate execution, the user expressly agrees to immediate execution and waives their right of withdrawal where applicable.
Service Availability
VSI INNOVATION endeavors to provide access under reasonable conditions but does not guarantee uninterrupted or error-free availability.
The platform may be temporarily unavailable due to maintenance, updates, incidents, hosting constraints, force majeure, or third-party failures.
VSI INNOVATION may modify, suspend, or discontinue services at any time without compensation.
Limitation of Liability
People Analyzer™ is provided as a decision-support tool. VSI INNOVATION does not guarantee any specific outcome, performance, recruitment success, or accuracy of interpretation.
VSI INNOVATION shall not be liable for decisions made based on platform outputs.
- misinterpretation of results;
- use outside intended purpose;
- HR or managerial decisions;
- discriminatory or unlawful use;
- inaccurate user data;
- misconfiguration of access;
- temporary unavailability;
- loss of revenue, data, or reputation;
- indirect or consequential damages.
Liability is limited to amounts paid in the previous 12 months, except in cases of gross negligence or mandatory law.
Prohibited Use
The service may not be used as the sole basis for decisions affecting individuals, including recruitment, evaluation, sanction, or termination.
Suspension and Termination
VSI INNOVATION may suspend or terminate access without notice in case of breach, misuse, security risk, or non-payment.
Personal Data
Personal data processing is described in the Privacy Policy available on the website.
Confidentiality
All non-public information accessed through People Analyzer™ is confidential and must not be disclosed to unauthorized third parties.
Force Majeure
VSI INNOVATION shall not be liable for failures due to events beyond its control.
Modification
VSI INNOVATION may modify these T&Cs at any time. The applicable version is the one in force at the time of use.
Governing Law
These T&Cs are governed by French law.
Disputes
In case of dispute, parties will attempt amicable resolution. Failing that, French courts shall have jurisdiction.
Additional Provisions
No waiver, partial invalidity, or independent contractor relationship shall affect the enforceability of these T&Cs.
Partner consultants act independently and are solely responsible for their services.
